1. Call to Order and Roll Call


Commissioner Berliner called the meeting to order at 5:04 pm. Commissioners present: Wu, Berliner, Edelhart; Commissioners absent: Cardenas; Staff present: Adele Failes-Carpenter; There was quorum.

2. Approval of Agenda (Action Item)



Commissioner Edelhart, seconded by Commissioner Wu, moved to approve the agenda. There was no public comment. The motion was approved by acclamation.

3. Approval of Minutes (Action Item)

Commissioner Berliner, seconded by Commissioner Edelhart, moved to approve the minutes. There was no public comment. The motion was approved by acclamation.

5. Presentations (All Items to Follow Discussion and Possible Action)



A. SFPD data-sharing with Family and Children Services
Presenter: Captain Gracie, San Francisco Police Department

Acting-Captain Edward Santos greeted commissioners and explained he was newly assigned to the Special Victims Unit as the officer in charge and that Captain Gracie had been reassigned to the Tactical Unit. He explained that he was committed to providing accurate information and hearing community perspectives. He explained that all seems to be going smoothly with the DGO 6.09 implementation. Since the SVU has 8 internal units, Acting-Captain Santos explained he is now reviewing the implementation of DGO 6.09 and would be happy to hear and follow up on youth commissioners’ questions.

Youth commissioners shared the following questions:


No. Youth Commissioners asked at October 2014 Police Commission Meeting: Follow up Questions:
#1 Institute clear data-collection and sharing capacities through the establishment of an MOU with FCS that includes provisions for collecting data on SFPD referrals to FCS including age, race, ethnicity, language, whether an arrest was made, and outcomes in FCS including services provided, cases accepted for investigation, placement, and family reunification. We would ask that this data be shared with youth commissioners in order to fulfill their chartered duties of collecting all information relevant to advising the Board of Supervisors and Mayor on the effects of policies concerning the children and youth of San Francisco.
• Are there plans to create an MOU be-tween FCS and SFPD? And where are we with this?
• What means of tracking number and details referrals to FCS does SFPD have?
• How are referrals logged by officers?
• What means do SFPD or FCS have of tracking outcomes for the youth/children referred by SFPD?
• Does SFPD or FCS track info re: the-se outcomes by age, race, ethnicity, language, whether an arrest was made, and outcomes in FCS including services provided, cases accepted for investigation, placement, and family reunification?
• Does SFPD have a MOU with FCS for sharing this data? What else is in the MOU?
#2 Re-commit to implementing training for officers on working with juveniles, including recognizing and responding to trauma in juveniles, which has been a priority of the youth commission’s since 2012.
• How soon will these trainings occur?

• How will officers be trained in the circum-stances under which FCS referrals should happen or not happen? What is the training like, and who will be training the officers?

• How else are youth/children getting referred to other needed services through SFPD, ie, CBHS?
#3 The stakes concerning section G are too high for this to be the last time this policy is reviewed. We would like the Chief to agree to review the data in 6-12 months to assess the policy for disproportionate impacts on communities of color; and whether the intended outcomes of linking young people to trauma services have been met; with a commitment to revisiting the general order, if necessary.
• What data and tracking capacities would need to be in place to do this assessment?
• What services will officers be linking young people to?
• Are officers prepared to link to services through CBHS/DPH or only FCS?


Committee members also asked about how the use of the referral cards was going. Acting-Captain Santos affirmed he would follow up on the questions and explained that he would like youth commissioners to come out to speak with officers and share perspectives sometime.

6. Business (All Items to Follow Discussion and Possible Action)



A. Review outstanding questions regarding CPS referrals

Committee members directed staff to reach out to Family and Children Services to learn more about the data-sharing capacities with SFPD. There was no public comment.

B. Review Updates from SFPD-SFUSD MOU Implementation Process

Staff updated that the MOU report at Board of Education had been moved to February and that Lt. Fatooh would send the campus arrest data at end of week. Committee members generated the following questions about MOU implementation:

• What are the criteria for officers to be assigned as SRO’s? What type of training and experience do they have?
• What SRO trainings have occurred this year? Can we observe an upcoming training?
• How has the MOU been distributed within SFPD?
• How has the MOU been distributed at school sites? Have principals and teachers been trained?
• How can students learn about the MOU? Could we develop pamphlet with the SAC?
• How have things been going with on campus arrests? Where arrests being made? Who is getting arrested and what for? What is the outcome for these youth?
• Are there youth members on the restorative justice task force/oversight committee?

C. Review next steps for CIP priorities

Committee members suggested that they meet with Project WHAT again at their regularly scheduled February 24th meeting. There was no public comment.

D. Review other committee priorities

Committee members confirmed that Commissioners Edelhart and Cardenas should attend the meeting with Chief Nance at Juvenile Probation on February 10th. Commissioners Berliner and Wu will attend a meeting with domestic violence and youth advocates. A member of the committee would also need to attend the report on the MOU implementation at Board of Education on February 10th. There was no public comment.


7. Staff Report



Staff confirmed the SF Criminal Justice allies are having a retreat on Thursday and staff would attend. Staff confirmed the all-chapter phone call for Dignity in Schools on February 18th.
